Term of Use for Finnable Technologies Private Limited
This Term of Use ("Agreement") governs the use of the website www.finnable.com ("Website") and the mobile application "Finnable" ("Application") (collectively, the "Platform") offered by Finnable Technologies Private Limited ("Finnable" or "Company"). By accessing or using the Platform, you ("User" or "Customer") agree to be bound by this Agreement.
1. Definitions
Lender: Any Non-Banking Financial Company (NBFC) or bank partnered with Finnable that provides Personal Loans to Users through the Platform.
Personal Loan: A loan provided by a Lender to a User for personal, family, or household purposes.
Credit Facility: This refers to the Personal Loans offered through the Platform.
2. Obligations of Parties
(a) User Obligations:
You agree to use the Platform only for lawful purposes and in accordance with this Agreement.
You are responsible for maintaining the confidentiality of your account1 credentials and for all activities that occur under your2 account.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform without the express written permission of Finnable.
You agree not to use the Platform in any way that could damage, disable, overburden, or impair the Platform or interfere with any other party's use of the Platform.3
You understand and acknowledge that Finnable is not a Lender and does not provide Personal Loans. Finnable merely facilitates the application process for availing Personal Loans from Lenders.
(b) Finnable Obligations:
Finnable will provide the Platform in a professional and workmanlike manner.
Finnable will use commercially reasonable efforts to ensure the Platform is available 24 hours a day, 7 days a week, except for planned maintenance or downtime.
Finnable will take reasonable measures to protect User data from unauthorized access or disclosure.
Finnable will facilitate the Personal Loan application process by collecting User information and forwarding it to relevant Lenders.
3. Limitations of Liability
The Platform is provided "as is" and without warranty of any kind, express or implied.
Finnable and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the4 Platform.
In no event shall the total liability of Finnable and its affiliates to you for all damages, losses, and causes of action arising out of or relating to this Agreement shall be limited to and not exceed the amount paid by you,5 if any, for accessing the Platform.
Finnable does not guarantee that you will be approved for a Personal Loan or that any Lender will offer you a Personal Loan. The decision to approve or deny a Personal Loan rests solely with the Lender.
Finnable is not responsible for the actions, omissions, or terms offered by any Lender. Any agreement for a Personal Loan is solely between the User and the Lender.
4. Intellectual Property
The Platform and its entire contents, features, and functionality (including but not limited to all information, software,6 text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by7 Finnable, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.8
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.9
No right, title, or interest in or to the Platform or any content on the Platform is transferred to you, and all rights not expressly granted are reserved by10 Finnable.
5. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of11 India, without regard to its conflict of law provisions.
Any dispute arising out of or relating to this Agreement shall be12 subject to the exclusive jurisdiction of the courts of13 Bangalore, Karnataka, India.
6. Availability
The Platform is available on the Website (www.finnable.com) and as an application called "Finnable" on the Google Play Store and Apple App Store.
7. Entire Agreement
This Agreement constitutes the entire agreement between you and Finnable with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral14 or written, between the parties.
8. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.15
9. Waiver
No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term, and16 Finnable's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.17
10. Credit Score Access
In addition to any consent you may give pursuant to the Privacy Policy, you hereby consent to Lenders retrieving your credit score from third party providers for the purpose of evaluating your eligibility for a Credit Facility. For the avoidance of doubt, the Company itself does not retrieve your credit score from any source.
By clicking the checkbox during the log in process, you hereby give your consent and authorize Finnable to initiate your application through the online prefill product provided by NSDL and Equifax basis name and mobile number submitted by you. You hereby also agree that in case of any error or mistake in any of the field during prefill of application, you shall inform us immediately for rectifying such errors or mistakes without any recourse to NSDL and Equifax does not guarantee accuracy, adequacy or completeness of the information provided.
11. Grievance Redressal Mechanism
The Company has invested in the best-in-class CRM system to ensure timely resolution of the grievances. The system captures the complaints; follows TATs based on the nature of the query and escalates issues on the basis of predefined TATs and as per the escalation matrix. Once captured in the CRM system, the customer care will be responsible for resolution of complaint/grievance to the customer’s satisfaction within a period of 14 working days. Every attempt will be made to offer the customer suitable and appropriate alternate solutions wherever possible. However, if the customer continues to remain dissatisfied with the resolution, (s)he can escalate the issue through the grievance redressal mechanism as referred below.
TIME FRAME
Suitable timelines of 14 working days have been set for every complaint depending upon the investigations which would be involved in resolving the same. Complaints are suitably acknowledged on receipt and the customers are informed of delays if any, in the resolution.
REVIEW AND MONITORING
Periodic review of monitoring of complaints, TATs, nature of complaints will be done to ensure that process loopholes, if any, are plugged and trends are checked.
ESCALATION MATRIX:
Customer care: Borrowers are requested to address all their grievances at the first instance to the Customer care team. The contact details of the Customer are: Email Id: makeiteasy@finnable.com. The Customer care team shall endeavor to resolve the grievance within a period of 14 (fourteen) days from the date of receipt of a grievance.
Grievance Redressal Officer: If the Borrower does not receive a response from the Customer care team within 14 (fourteen) days of making a representation, or if the Borrower is not satisfied with the response received from the Customer care team, the Borrower may reach out to the Grievance Redressal Officer on the number below anytime between 10 AM and 7 PM from Monday to Saturday except public holidays or write to the Grievance Redressal Officer at the e-mail address below.
